1. Who we are

The Website is owned and operated by Fractive Ltd, a company registered in England and Wales (company number 15328357), which trades as The Fractions and operates this Website under the SMEmoney brand. In these Terms, "SMEmoney", "we", "us" and "our" refer to Fractive Ltd.

2. What SMEmoney is, and what it is not

SMEmoney is an introduction service. We are not a lender, a broker, an insurer or an insurance brokerage. We do not lend money, place insurance, or provide regulated financial advice.

What we do is connect UK businesses with specialist broker and brokerage partners. On the funding side, those partners have access, between them, to over 70 UK lenders. On the insurance and protection side, the specialist brokerages we introduce customers to place cover across a panel of UK insurers. In every case, the regulated advice, the application process and the final decision sit with the authorised firm you are introduced to, not with us.

We introduce and we compare. We do not advise, arrange, underwrite or lend.

3. Use of the website

You may use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

• use the Website in any way that breaches any applicable law or regulation
• use the Website to transmit any material that is defamatory, obscene, or otherwise unlawful
• attempt to gain unauthorised access to the Website, the server on which it is stored, or any server, computer or database connected to it
• introduce any viruses, malware or other harmful material
• reproduce, copy or resell any part of the Website except as permitted by these Terms

We may suspend, withdraw or restrict the availability of all or any part of the Website for business or operational reasons at any time, and we will try to give reasonable notice where we can. We do not guarantee that the Website, or any content on it, will always be available or uninterrupted.

4. Intellectual property

All content on the Website, including text, graphics, logos, images, calculators and layout, is owned by Fractive Ltd or its partners and is protected by intellectual property laws. You may view and print content for your own business use, but you may not reproduce, distribute, or commercially exploit any part of it without our prior written consent.

5. Disclaimers

The content on the Website is provided for general information only. It is not, and should not be relied on as, regulated financial, legal, tax or accounting advice, and it does not take account of your particular circumstances. Any regulated advice will come from the authorised firm you are introduced to, not from us.

Any calculators, illustrations, rates or figures shown on the Website are indicative only. They are intended to help you understand your options in general terms. They are not a quote, an offer, or a promise of funding or cover, and the actual terms available to you will depend on the lender, insurer or provider and on your own circumstances.

We do not guarantee that any introduction will result in an offer of funding, an insurance policy, or any particular outcome. Approval, pricing and terms are decided by the relevant lender, insurer or provider, based on their own criteria.

Where the Website discusses tax treatment, such as capital allowances or the tax position of a particular product, this is general information only. You should always speak to a qualified accountant or financial adviser to understand how any of it applies to your specific situation before acting on it.

The Website may contain links to third-party websites. Those links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss that may arise from your use of them.

While we take reasonable care to keep the information on the Website accurate and up to date, we make no representations or warranties, whether express or implied, that it is complete, accurate or current.

6. Use of your personal data and UK GDPR

We take the protection of your personal data seriously and handle it in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Data controller. Fractive Ltd is the data controller for the personal data you provide through the Website. You can contact us about data protection matters by email at info@smemoney.co.uk, or by writing to us at our registered office above.

ICO registration. Fractive Ltd is registered with the Information Commissioner's Office (ICO) under registration reference ZB648666.

What we collect. When you use our calculators, complete an enquiry or application form, or otherwise contact us, we may collect information such as your name, contact details, business details, and information about the funding or cover you are looking for.

Why we use it, and our lawful bases. We use your personal data to respond to your enquiry, to match you with a suitable broker or brokerage partner, and to make that introduction. Depending on the situation, we rely on one or more of the following lawful bases: your consent; our legitimate interests in operating and improving our introduction service; and taking steps at your request before you enter into any arrangement with a partner firm.

Who we share it with. To provide the introduction service, we pass your details to the broker or brokerage partner we match you with. That partner may in turn share your information with the lenders or insurers on its panel in order to source funding or cover for you. Each of those firms will handle your data as a controller under its own privacy policy, and we would encourage you to read the privacy information of any firm you are introduced to. We do not sell your personal data.

Marketing. We will only send you marketing communications where you have agreed to receive them or where we are otherwise permitted to do so. You can opt out at any time by contacting us or by using the unsubscribe option in any message.

Retention. We keep your personal data only for as long as necessary for the purposes described above, or for as long as we are required to keep it to meet our legal and regulatory obligations, after which it is securely deleted.

International transfers. Where your personal data is processed outside the UK, we take steps to ensure it is protected by appropriate safeguards recognised under UK data protection law.

Your rights. Under the UK GDPR you have the right to access your personal data, to have it corrected or erased, to restrict or object to its processing, to data portability, and, where we rely on consent, to withdraw that consent at any time. Complaints to the ICO. If you are unhappy with how we have handled your personal data, you have the right to complain to the Information Commissioner's Office at ico.org.uk, or by calling 0303 123 1113. We would appreciate the chance to address your concerns first, so please do contact us before you approach the ICO.

7. Cookies

The Website uses cookies and similar technologies to help it function and to understand how it is used. You can manage your cookie preferences through your browser settings and, where provided, through the cookie banner on the Website. See our Cookie Policy for full details.

8. How we are paid, and commission disclosure

Our calculators and our introduction service are free for you to use. We do not charge you a fee for introducing you to a broker or brokerage partner.

We are paid by the firms we work with. Depending on the arrangement, this may take the form of a commission, or a fee for the sales lead we generate, paid to us by the broker, brokerage, lender or insurer to whom we introduce you. This does not increase the cost to you, and being paid in this way does not affect our obligation to make introductions that are appropriate to the information you give us.

You are entitled to ask us about the nature of any commission or fee we receive in connection with your introduction, and we will tell you. Where a product involves commission paid by a broker or insurer, the firm that arranges that product will also disclose the relevant commission or fee information to you as part of its own process.

9. Complaints

We want you to be happy with our service. If something has gone wrong, please tell us so we can put it right.

Complaints about our service. If your complaint is about the introduction service we provide, or about the Website, please contact us at complaints@smemoney.co.uk, or write to us at our registered office. Please give us your name, contact details, and a description of what has happened. We will acknowledge your complaint promptly and work to resolve it as quickly as we reasonably can.

Complaints about a product or about regulated advice. If your complaint is about the advice you received, or about a funding or insurance product itself, that is the responsibility of the authorised firm that advised you or provided the product. Please raise it with that firm directly, as it is best placed to deal with it. If you are ever unsure who to contact, you are welcome to raise it with us first and we will point you in the right direction.

The Financial Ombudsman Service. In relation to the regulated activities of an authorised firm, you may be able to refer your complaint to the Financial Ombudsman Service if you are not satisfied with that firm's final response. The Financial Ombudsman Service can be contacted at financial-ombudsman.org.uk, by telephone on 0800 023 4567, or by post at Exchange Tower, London, E14 9SR. The authorised firm dealing with your complaint will confirm whether the Ombudsman is available to you and how to refer your complaint.

10. Our liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Subject to that, we are not liable to you for any loss or damage, whether in contract, tort (including negligence) or otherwise, arising out of or in connection with:

• your use of, or inability to use, the Website
• your reliance on any content, calculator, illustration or information on the Website
• any decision made by a lender, insurer, broker or brokerage, or any dealings you have with any firm we introduce you to; or
• any business loss, including loss of profit, loss of revenue, loss of business, or loss of anticipated savings

Any introduction we make does not amount to a recommendation or endorsement of any particular firm, product or outcome.

11. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the law, in regulation, or in how we operate. The version published on the Website is the version that applies to your use of it, so please check this page from time to time. The date at the top shows when these Terms were last updated.

12. Governing law

These Terms, and any dispute arising out of or in connection with them or your use of the Website, are governed by the law of England and Wales, and the courts of England and Wales will have exclusive jurisdiction.
